The Digital Personal Data Protection Act, 2023 establishes a legal framework governing the processing of digital personal data in India. Organisations that fall within its scope may have obligations relating to personal-data processing, security safeguards, data-principal rights, breach management, and other areas.

The Act and its associated rules have specific applicability and requirements depending on the organisation and its role in processing personal data. Obligations can also vary depending on the nature and scale of processing and whether an organisation is classified as a Significant Data Fiduciary.

Penalty Schedule (Maximum)

Up to ₹250 Cr Breach of obligations related to security safeguards for personal data (Schedule, Item 1)
Up to ₹200 Cr Breach of obligations related to notifying the Board and affected Data Principals of a personal data breach
Up to ₹150 Cr Breach of obligations relating to additional obligations for processing children's data
Note Penalty amounts are maximums set in the Schedule. Actual penalties are determined by the Data Protection Board based on the specific breach, its nature, and applicable factors. Organisations should obtain legal advice for interpreting their specific obligations.
